People often believe that you must be very wealthy to do "an estate plan." In California, the probate process is necessary (with some exceptions) for an estate with over $184,500 or even real property over $61,500 after April 1, 2022 (at the time of this update in 2023). A will and/or a trust indicating your wishes and instructions on handling your estate can save money, time and aggravation between potential heirs. An attorney and/or an executor can get at least $7,000 each for a $200,000 probate estate. Additionally, a good estate plan should include a power of attorney and a health care directive to allow an agent to help you during life if you become incompetent for some reason. An agent can help you take care of yourself and your possessions. Other family members will have to go to Court to get a conservatorship to help you and spend $5,000-$10,000 in attorney fees and court costs in uncontested cases.
